Definitions:
“Club” means Newcastle United Football Company Limited (company number: 00031014).
“Gift Voucher” means the voucher to be used to purchase tour tickets at St. James’ Park.
“Membership” means the membership scheme operated by the Club from time to time.
“Stadium” means the football stadium at St James’ Park, Barrack Road, Newcastle upon Tyne, NE1 4ST and surrounding premises owned by the Club.
“Terms and Conditions” means these terms and conditions applicable to the purchase of a Gift Voucher.
“Tour” means a guided tour of the Stadium.
Any references to “you” are to the individual who is purchasing or has purchased a Gift Voucher.
1. Purchasing a Gift Voucher
1.1 Gift Vouchers can be purchased on the Club’s website, by telephone on 0191 201 8704 or whilst at the Stadium by speaking to a member of the Club’s Tours team.
1.2 All Tour bookings made with a Gift Voucher are subject to the St James’ Park Tour Terms and Conditions, which can be found here on our website.
1.3 The minimum purchase for a Gift Voucher is £11 (eleven pounds) (or the then current price charged for a junior ticket, as notified to you on the website from time to time).
1.4 You can choose to receive your Gift Voucher electronically (in digital form), or in hard copy. Additional charges for hard copy Gift Vouchers may apply, and these will be notified to you when you make your purchase.
1.5 All Gift Vouchers purchased in hard copy shall be sent via post within 3 (three) business days. The Club takes no responsibility for the delayed arrival of Gift Vouchers by post. All postage costs shall be highlighted to you at the point of purchase.
1.6 It is your responsibility to ensure that all information provided to the Club when purchasing a Gift Voucher is accurate (for example, if the Gift Voucher is being posted to the recipient, you must ensure that the correct postal address is entered). The Club takes no responsibility for any inaccurate information provided by you.
2. How do I redeem a Gift Voucher?
2.1 Gift Vouchers can be redeemed by contacting the Club’s Tours team either by telephone: 0191 201 8704, via email: [email protected] or online: at booknewcastleunited.co.uk.
2.2 The pin number on the Gift Voucher will be required when booking a Tour.
2.3 Gift Vouchers may only be redeemed against the Tour for which the Gift Voucher has been purchased. For example, a Gift Voucher for a ‘Classic Tour’ cannot be used to book a ‘Rooftop Tour’. In addition, a Gift Voucher purchased for a specific type of ticket, for example a ‘Junior’ ticket may only be used by an individual who would be classed as a ‘Junior’ as advertised online at booknewcastleunited.co.uk.
2.4 Gift Vouchers are not redeemable against anything other than Tours, for example, you may not use the Gift Voucher for Box Office tickets, hospitality, merchandise within the Club shop or anything else sold by the Club either online or in person.
2.5 Gift Vouchers shall expire 12 (twelve) months from the date of issue. The Gift Voucher expiration date will be stated on the Gift Voucher and the Gift Voucher cannot be used or redeemed after that date.
3. Gift Voucher Limitations
3.1 Gift Vouchers cannot be resold, transferred for value or redeemed for cash.
3.2 Gift Vouchers cannot be used to purchase another Gift Voucher.
3.3 Gift Vouchers cannot be refunded or exchanged.
3.4 Promotional codes cannot be used in conjunction with any Gift Vouchers.
3.5 Membership discount cannot be used in conjunction with Gift Vouchers.
3.6 The Club shall cancel and void the Gift Voucher, with or without notice, if the payment for the Gift Voucher is not duly received from the purchaser’s bank or card company. Further action may be taken by the Club where the fraudulent use of a credit card is suspected.
3.7 Gift Vouchers cannot be sold to any third parties or auctioned as a prize without the Club’s prior written consent and shall be subject to any conditions imposed by the Club. The Club reserves the right to cancel any Gift Vouchers sold in this manner.
4. Loss, Theft, Refunds and Cancellations
4.1 The risk of loss and the title to the Gift Voucher shall pass to the purchaser upon the Club’s electronic or physical transmission of the Gift Voucher to the purchaser or chosen recipient.
4.2 Gift Vouchers cannot be replaced or refunded if the Gift Voucher is lost, stolen or destroyed.
4.3 The Club shall refund the purchaser in full for the Gift Voucher if the purchaser requests a cancellation within 14 (fourteen) days of the date of purchase provided that the recipient of the Gift Voucher has not made a booking in that time.
4.4 If you attend the Stadium for a Tour and the Gift Voucher held by you is incorrect, the Club will use its reasonable endeavours to offer you an alternative date for the Tour.
4.5 In the unlikely event where the Club needs to cancel a Tour booked using a Gift Voucher, the Club will contact the recipient via email or telephone to arrange an alternative date and time.
5. General
5.1 If you have any complaints, our Supporter Services Team will do their best to resolve any problems you have with us or our Gift Vouchers as per our Complaints policy which can be found on our website.
5.2 The Club reserves the right to change these Terms and Conditions from time to time and shall notify you of such changes via the Club’s website or any appropriate means of communication.
5.3 You shall not assign this Contract or its rights and/or obligations under it or grant any rights whatsoever by way of sub-contract, licence, or otherwise to any other person in respect of the Tour.
5.4 The Club may assign and/or sub-contract any of its rights and/or obligations under this Contract with you.
5.5 No variation of the Contract or these Terms and Conditions shall be valid unless it is in writing and signed by or on behalf of both you and the Club.
5.6 Any person who is not a party to this Contract shall not be entitled to enforce any of its terms, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
6. Governing Law and Jurisdiction
6.1 These Terms and Conditions are governed by English law and any dispute or claim arising out of or in connection with them can be brought in the courts of England. If you live in Wales, Scotland or Northern Ireland, you are entitled to bring a claim in the courts of the country you live in.
