Terms

These terms and conditions (“Conditions”) apply to the Celebration Event on the Town Moor on Saturday 29 March 2025 (“Event”) to which you have obtained a digital ticket (“Ticket”). References to “the Club” and “we” shall mean Newcastle United Football Company Limited, and references to “you” and “your” shall be to the individual who has obtained a Ticket.

1. The Event Information

1.1. The Event shall, unless otherwise notified to you:

1.1.1. be held on Saturday 29 March 2025;

1.1.2. be at the location notified to you on your Ticket on the Town Moor, Newcastle upon Tyne;

1.1.3. start at 1.30pm (13:30 GMT) where you will be expected to show your Ticket on arrival to gain entry at one of the entrances, an inability to show your Ticket will mean that entry is refused without any liability to you;

1.1.4. finish at approximately 8pm (20:00 GMT), therefore please leave the area once the Event is finished;

1.1.5. have several entry and exit points, which must be used to gain access and leave the area;

1.1.6. be alcohol-free, therefore please do not bring any alcohol with you to the Event or arrive at the Event intoxicated;

1.1.7. continue unless the weather conditions are such that either the whole Event is cancelled, or certain aspects of the Event are cancelled or changed, to which the Club shall hold no liability to you whatsoever or howsoever arising.

1.2. The Club will endeavour to inform you of any changes to the Event, however it may not be possible to do so in all circumstances. Please consult the Club’s website and app for up-to-date Event information.

1.3. Tickets to the Event are free. All ticketing information may be found on the Club’s website https://support.newcastleunited.com/hc/en-gb/sections/19124600766108-Carabao-Cup-Celebration. Tickets are not transferable and may not be or (i) offered for sale in any capacity or (ii) transferred without the prior written permission of the Club.

1.4. It is your responsibility to arrange your travel to and from the Event. There will be no parking and no reserved areas except for areas related to those with accessibility requirements. The Club advises you to plan your journey accordingly.

2. Rules at the Event

2.1 By attending the Event, you agree to adhere to and be bound by the following rules:

2.1.1. You must always act responsibly, safely and sensibly;

2.1.2. You must not attend if you are under the influence of alcohol or non-prescription drugs. We reserve the right to ask you to leave;

2.1.3. You must follow any safety warnings or instructions displayed or given to you by a steward. Please ask if you are unclear;

2.1.4. In case of bad weather, please take extra precaution as the ground may be slippery, soft and/or uneven;

2.1.5. You acknowledge the Club's right to search any person entering the Event and to refuse entry to or eject from the Event any person refusing to submit to such a search;

2.1.6. In the event of an accident, please immediately report to a steward for assistance;

2.1.7. You must not attend if you are pregnant. We are not qualified to express an opinion that you are able to safely attend the Event. You must obtain professional or specialist advice before attending if you are unsure;

2.1.8. Young people aged under 14 (fourteen) must be always supervised by an adult. Children aged under 2 (two) are not permitted to attend;

2.1.9. Alcohol is not permitted. If you attempt to bring and/or conceal alcohol, we reserve the right to refuse admission and/or to ask you to leave the Event;

2.1.10. You must not damage anything on the premises in any manner whatsoever nor commit or permit a breach of applicable laws (whether by your act or omission) or in any way cause a nuisance or be an infringement of any licence;

2.1.11. You shall not introduce nor attempt to introduce nor permit the introduction of any signage or other publicity material into the Event without the Club's consent;

2.1.12. You shall not film, broadcast nor produce any media coverage without the Club’s prior written consent (exercisable at its sole discretion); and

2.1.13. You shall be respectful of and not cause, whether knowingly or recklessly, any damage to any neighbouring property within the vicinity of the Event,

(together, the “Rules”)

2.2. Please ensure that you read the Frequently Asked Questions available on the Club’s website which apply to you in addition to these Conditions,

2.3. Timings for the Event are approximate. No guarantees can be given by the Club that a scheduled Event listing will take place at a particular time or at all.

2.4. If the Club, acting in its sole discretion, considers that you are in breach of the Rules, or these Conditions, the Club shall be entitled to ask you to leave the Event, and/or take such other action as it deems necessary (for example, contacting the Police in the event of breach of laws).

3. Club's Obligations

3.1. The Club will act with reasonable care and skill and in accordance with all legislation, statutes, regulations and other enactments having the force of law from time to time which are applicable to the hosting of the Event.

3.2. The Club shall be arranging independent third-party catering at the Event for you to purchase food and refreshments, including non-alcoholic drinks. Should you have any questions or complaints regarding the catering, you should direct those to the relevant third-party caterer directly.

4. Changes by the Club

The Club may change the Event or suspend any part of the Event without reference to you at its discretion, including (without limitation) to reflect changes in legislation and regulatory requirements which may affect any aspect of the Event and/or to implement minor technical adjustments and improvements (for example, to address a security, safety or public health issue).

5. Delays and/or Cancellation

If the Event (or any part of it) is delayed or cancelled by something that is outside of the Club’s control, we will (where practicable) contact you to let you know or make an announcement at the Event. Under no circumstances will the Club be liable to you for any loss you may suffer because of delay(s) or cancellation(s) relating to the Event (or any part of it).

6. Data Protection

6.1. Further details of the Club’s data protection practices and on how the Club will collect, store, process and delete your personal data are set out in the Club’s privacy notice and CCTV and Imaging policy, both of which can be found on the Club’s website.

6.2. By attending the Event, you acknowledge that photographic images and/or audio, visual and/or audio-visual recordings and/or feeds (and/or stills taken therefrom) may be taken of you and may also be used, by way of example and without limitation, for promotional, training, editorial or marketing purposes by the Club, or others (including commercial partners), and your use of a Ticket to enter the Event constitutes consent to such use.

6.3. You further acknowledge that photographic images and/or audio, visual and/or audio-visual recordings and/or feeds (and/or stills taken therefrom) may be used (by the Club or by a third party, such as a law enforcement body) to identify you as an individual, where permitted by data protection laws, for the purposes of preventing or detecting crime, or any breach of these Conditions and may also be used in accordance with the Club’s CCTV and Imaging Policy.

6.4. You agree that the Event is public, and that their appearance and actions inside and in the perimeter of the Event public in nature, and that you shall have no expectation of privacy regarding your actions or conduct at the Event.

7. Your Property

7.1. The Club may need to restrict the amount and/or type of personal belongings (including but not limited to pushchairs and luggage) you can bring to the Event. If we permit you to bring any such item(s) to the Event, these always remain at your own risk.

7.2. You may not take any of the following items to the Event: knives, Illegal Substances, fireworks, smoke canisters, air-horns, flares, weapons, dangerous or hazardous items, laser devices, bottles, glass vessels, cans, poles and any article that might be used as a weapon and/or compromise public safety, hazardous, noxious or flammable substances. Any person in possession of such items will be refused entry to the Event. "Illegal Substance" means any drug which is not legally obtainable, or which is legally obtainable but has not been legally obtained. The term includes prescribed drugs not being used for prescribed purposes.

7.3. Please notify a member of Club staff of any lost property that is found at the Event.

8. Loss suffered by you

In the absence of any negligence or other breach of duty by the Club, attendance at the Event is entirely at your risk. The Club is not responsible for any theft, damage, destruction or loss of your property or belongings while attending the Event.

9. Safeguarding and welfare

9.1. You acknowledge the Club is committed to safeguarding vulnerable groups and expects all staff, players, volunteers, contractors, partners and guests to share this commitment.

9.2. The Club believes all staff, players, volunteers, contractors, partners, and guests have a responsibility to report to the Club any concerns they have about the welfare of any child or adult at risk.

9.3. You acknowledge that the Club has in place a Safeguarding Policy to ensure that as far as reasonably practicable all staff, players, volunteers, contractors, partners and guests are treated appropriately, respectfully and safely.

9.4. You acknowledge the Club expects your physical and verbal behaviour and conduct to be appropriate at all times and of a manner that maintains the Club’s safeguarding approach outlined in clauses 9.1, 9.2 and 9.3.

9.5. You acknowledge that should your behaviour be deemed as breaching clauses 9.1, 9.2 and 9.3, the Club reserves the right to take appropriate action, which may include involving external organisations such as the Police or Local Authority Social Care Services in such action, if deemed necessary.

9.6. The Club will:

9.6.1. comply with all applicable laws, statutes, and regulations relating to the duty to prevent sexual harassment including but not limited to, s40A of the Equalities Act 2010; and

9.6.2. take such action as it deems necessary where it is required to (in its sole opinion) act in accordance with its duty.

10. Equality and Diversity

In accordance with the guidance detailed within the Equality Act 2010, the Club is committed to ensuring its customers, patrons and anyone connected with the Club are treated with equality and respect at all times. The Club acknowledges its duties and responsibilities as defined by the Equality Act 2010 to ensure that its customers, patrons and anyone connected with the Club are protected from discrimination, harassment and victimisation. The Club expects you to share this commitment and requires that your behaviour reflects this at all times during the Event. The Club reserves the right to eject any person found to behave in a manner that does not adhere to the above and the Club may seek further action for those involved or reporting the matter to the Police.

11. General

11.1. Nothing in these Conditions shall be construed as restricting any of your statutory rights. To the extent that there is any conflict between any consumer statutory right and these Conditions, the statutory rights will prevail.

11.2. Nobody else has any rights under these Conditions. These Conditions are a contract between you and us and nobody else can enforce it.

11.3. If a court or other authority invalidates or decides that any of these Condition(s) are unlawful, the remainder will continue to apply.

11.4. Even if the Club delays in enforcing these Conditions, the Club can still enforce any part of them later. #

11.5. These terms are governed by English law and wherever you live you can bring claims against the Club in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against the Club in the courts of the country you live in. The Club can claim against you in the courts of the country you live in.
